Terms of Engagement

By purchasing services from Bluejay Design and entering into a working relationship with the company, the client agrees to the following Terms and Conditions.

Service Commitment

Bluejay Design is committed to delivering high-quality creative and digital services with a strong focus on client satisfaction. Our team will continue refining the project within the scope of the selected package until the approved deliverables are completed.

Revision availability is based on the package selected at the time of purchase.

Revision Policy

Clients may request revisions according to the revision limit included in their selected package. Revisions apply to the approved design direction and existing concept scope.

Additional charges may apply in cases involving:

  • Complete redesign requests
  • Major concept changes
  • New functionality or expanded scope
  • Requests beyond the included revision limit

Revised work is generally delivered within 48 to 72 business hours, depending on project complexity.

Turnaround Time

Most design services have an initial turnaround time of 48 to 72 business hours for the first draft or design stage. Revision timelines may vary depending on feedback, scope, and project requirements.

Business days exclude weekends and public holidays.

Quality Assurance

Bluejay Design follows a structured quality review process to ensure all deliverables meet professional design and development standards. Every project is approached with research, planning, and attention to detail.

Delivery Policy

Completed files and deliverables are sent through the approved client account or communication channel upon project completion.

Website projects will only be published or deployed after all outstanding payments have been cleared.

Design Rights & Ownership

Ownership rights are transferred to the client only after:

  • Final approval has been provided
  • Full payment has been received

Upon completion, the client receives ownership rights to the finalized approved design files.

Bluejay Design retains ownership of all unused concepts, drafts, revisions, development files, and internal working materials created during the production process.

Content Creation & Website Population

Content writing, product uploads, and website population services are only included when specifically purchased or agreed upon.

Where applicable:

  • Clients must provide accurate text, product information, and media assets
  • Product data should be supplied in approved file formats such as CSV or XLS
  • Additional data entry or bulk uploads beyond agreed limits may incur extra charges

Bluejay Design may use licensed stock imagery where approved by the client. The company is not responsible for similarities between licensed stock content used across external websites.

Content Compliance Policy

Bluejay Design maintains a neutral business position and reserves the right to decline or terminate projects involving:

  • Religious promotion or criticism
  • Political campaigns or ideological messaging
  • Hate speech or discriminatory material
  • Geopolitical conflicts or extremist content
  • Illegal, misleading, or harmful activities

If restricted content is introduced after project initiation, Bluejay Design may terminate the agreement immediately.

Applicable refunds, if any, will follow the agreed service terms.

Confidentiality & Non-Disclosure

Bluejay Design treats all client information and project materials as confidential unless disclosure is required by law.

Upon project completion, both parties agree not to intentionally damage or misrepresent the reputation of the other party, including employees, contractors, affiliates, or representatives.

Record Maintenance

Bluejay Design may retain archived copies of finalized project files for backup and recovery purposes.

Customer Support

Customer support is available during official business hours, Monday through Friday, 9:00 AM to 5:00 PM EST.

Requests submitted outside business hours will be addressed on the next working day.

Technical Support Policy

Bluejay Design primarily provides creative, branding, website, and consulting services. Technical support is limited to the scope defined within the purchased package.

Website Deployment
  • Websites may be deployed on hosting provided by the client or purchased through Bluejay Design
  • Bluejay Design is not responsible for third-party hosting server performance, outages, or technical failures
  • Ongoing maintenance or support is only provided under a separate maintenance agreement
CMS & Website Management
  • Basic guidance or documentation may be provided for supported content management systems
  • Dedicated training services are not included unless specifically purchased
Email Configuration
  • Necessary setup information may be provided for email configuration
  • Bluejay Design is not responsible for device setup, third-party email software, or troubleshooting external email issues

Clients are responsible for managing and operating delivered systems after project completion unless ongoing support services are included.

Communication Policy

All project communication, approvals, revisions, and refund requests must be submitted through official Bluejay Design communication channels.

Bluejay Design is not responsible for issues resulting from communication through unauthorized platforms, unofficial contacts, or unverified email addresses.

Only communication sent through official company domains and approved support channels will be considered valid.

Termination Policy

Bluejay Design reserves the right to suspend or terminate a project or service agreement under the following circumstances:

  • Violation of company policies or Terms & Conditions
  • Failure to provide required project materials or approvals
  • Delayed or incomplete payments
  • Misrepresentation of project intent or requirements
  • Abusive, unethical, or unprofessional conduct
  • Requests involving illegal activity or intellectual property infringement
  • Extended inactivity exceeding fourteen (14) consecutive days
  • Situations that may expose Bluejay Design to legal, operational, or reputational risk

Upon termination:

  • Services and revisions will immediately cease
  • Deliverables may be withheld until contractual obligations are resolved
  • Refund eligibility, if applicable, will be reviewed according to the agreed service terms

All termination decisions made by Bluejay Design management are final.

Refund Policy

Bluejay Design offers refunds under specific conditions outlined below. Refund eligibility depends on the project stage, scope of work completed, and compliance with company policies.

Refunds Are Not Applicable Under the Following Circumstances
  • A custom or discounted package has been selected
  • Initial concepts have been approved
  • Multiple revision rounds have been completed
  • Final files have been delivered
  • A website has been approved, developed, or deployed
  • The client becomes unresponsive for more than fourteen (14) days without notice
  • The project is paused or delayed at the client’s request
  • Company policies or terms have been violated
  • Another agency or designer has been engaged for the same project during production
  • The client fails to provide required project information or assets
  • A complete change in project direction is requested after work has started
  • The business closes, changes ownership, or rebrands during the project
  • The refund request is based on personal preference changes unrelated to service quality

Refunds are not available for third-party or non-design services, including but not limited to:

  • Website hosting
  • Domain registration
  • SSL certificates
  • Website maintenance plans
  • SEO services
  • Social media marketing campaigns
  • Paid advertising services

In certain cases, Bluejay Design may offer a partial refund at management discretion after project evaluation.

Cancellation Fees

Orders canceled within 24 hours may be subject to administrative charges if project preparation or resource allocation has already begun.

Cancellation requests unrelated to service quality may also incur administrative fees.

Refund Requests

Clients may request a refund by:

  • Contacting their assigned Project Manager
  • Using the official support or live chat channels
  • Sending an email through the registered communication address

All refund decisions are reviewed internally and finalized by Bluejay Design management.

Once a refund is processed, the client forfeits all rights to any concepts, drafts, or materials created during the project unless otherwise agreed in writing.
